The bill will introduce a new Private Rented Sector Database. All landlords of assured and regulated tenancies will be legally required to register themselves and their properties on the database. The aim is to give Landlords one access point to relevant guidance which can also be used to give updates on regulations and landlords responsibilities.
The database will be online, but it’s stated that alternative offline ways will be offered. It’s anticipated that Landlords will be required to pay to register but it’s stated that “we will work to ensure that the fee is proportionate and good value”.
The database will provide local councils with more data about the private rented sector, and they will have powers to enforce action against landlords who fail to register. They will be able to issue civil penalties up to £7000. Repeated breaches or if a serious offence is committed, such as providing fraudulent information to the database, a civil penalty of up to £40,000 could be imposed or criminal prosecution. In addition, Landlords who fail to register will not be able to get a possession order except on the grounds of anti-social behaviour.
The Government have yet to determine how much information will be made public and it’s intended to replace the database of Rogue Landlords and allow certain offences to be viewable to allow tenants to make decisions of their rental choices. Furthermore, currently there is no thought of ending selective licensing and the two systems will be enforced by local councils.
The database is currently undergoing its digital developments and will need testing, but the aim is that it become operational following the passage of the primary and secondary legislation.
